IMPORTANT NOTICE to Applicant(s) For Credit (Section 18E Privacy Act 1988)
PART A – Giving information to a Credit Reporting Agency (Section 18E (8)(c) Privacy Act 1988)
It is agreed between the Applicant and First Netrader Pty Ltd (“FN”) that:
1. This notice comprises part of the Agreement between the Applicant and FN.
2. FN is authorised to give information (the ‘information’) about the Applicant and the Agreement to a credit reporting agency, for the following purposes:
2.1 To obtain a consumer credit report about the Applicant;
2.2 To allow the credit reporting agency to create or maintain a credit information file containing information about the Applicant.
3. The information includes but may not be limited to:
3.1 Identity particulars – the Applicant’s name, gender, address (including two previous addresses) date of birth, name of employer, and drivers licence number.
3.2 The Applicant’s application for consumer credit or commercial credit including the making of the Application for Credit and the amount.
3.3 The provision of credit by FN to the Applicant.
3.4 Any repayments required from the Applicant which are overdue by more than 60 days, and for which debt collection action has started.
3.5 Notice of any default of payment by the Applicant.
3.6 Notice by FN, where in the sole opinion of FN the Applicant has committed a serious credit infringement (including but not limited to fraud)or a declared intention by the Applicant not to comply with its credit obligations.
3.7 Cheques provided by the Applicant which are dishonoured or not paid on presentation for any reason.
3.8 Payment or otherwise discharge of the credit by the Applicant.
4. FN is authorised to give the information before, during or after provision of credit to the Applicant.
Part B – Access to Credit Information (Sections 18K and 18L Privacy Act 1988)
5. FN is authorised to obtain information including a commercial credit report about the Applicant from any person, business or corporate entity which provides information about the commercial credit worthiness of persons for the purpose of assessing the Application for commercial credit.
6. FN is authorised to obtain information including a consumer credit report about the Applicant from a credit reporting agency for the purpose of assessing the Application for commercial credit.
Part C – Exchange of Credit Worthiness Information (Section 18N Privacy Act 1988)
7. FN is authorised to exchange information in connection with the Applicant with credit providers in a consumer credit report issued for purposes including but not limited to:
7.1 Assessment of the Application for credit;
7.2 Notification of other credit providers of a default in repayment by the Applicant;
7.3 Assess the status of the Applicant’s credit with other credit providers;
7.4 To assess or verify from time to time the credit worthiness of the Applicant.
8. The information exchanged may include any information, data or document concerned or connected with the Applicant’s credit worthiness, credit standing, credit history or credit capacity.
Part D – Credit report by a credit reporting agency to assess a guarantor (Section 18K Privacy Act 1988)
9. FN is authorised to obtain information including a credit report from a credit reporting agency containing any and all information required by FN for the purpose of assessing whether to accept a person, business or corporate entity offered by the Applicant as guarantor for consumer credit.
Part E – Jurisdiction
10. This notice, the Agreement and any Application for credit:
10.1 was formulated in the state of Queensland;
10.2 are to be construed in accordance with the laws of Queensland;
11. FN and the Applicant submit to the exclusive jurisdiction of a court or tribunal within the geographical boundaries of Queensland in respect of any claim, demand or legal proceedings in connection with this notice, the Agreement or Application for Credit.
Part F – Severability
12. Any clause of this notice determined to be unenforceable or void shall be severed from the notice and ignored with the balance of the notice to remain binding and given full meaning and effect.
